There have been developments in the courts that currently allow the DACA program protections to continue in 49 states, including Wyoming. We are waiting for a final word on the USCIS’ policy following new guidance out of Texas. The U.S. District Court for the Southern District of Texas had issued an injunction halting DACA nationwide. This was appealed to the Fifth Circuit Court of Appeals. Earlier this year, the Fifth Circuit Court of Appeals had issued an order limiting the federal injunction to the jurisdiction of Texas. see State of Texas, et al. v. U.S.A, et al., 23-40653 (5th Cir. 2025).
This means that the protections under DACA will continue in 49 other states for the time being. Unfortunately, USCIS will not process any new applications. As of Spring 2025, the DACA program remains legally uncertain. For DACA recipients, often referred to as Dreamers, residing in Wyoming, this involves navigating a complex and constantly evolving policy environment. While the courts continue deliberating on DACA's future, those already participating in the program still have options. Here’s what you need to know if you live in Wyoming and rely on DACA protections.
Can You Still Apply for DACA in 2025?
No. Currently, the federal government is not processing new DACA applications. However, if you already hold DACA status, you can continue to apply for renewal, including your work permit. See https://www.uscis.gov/DACA. This remains a crucial opportunity for hundreds of thousands of immigrants who came to the U.S. as children and have established lives, careers, and families here. If you need to renew your DACA, it is important to do so promptly. Losing your DACA status will result in losing access to the protections offered by the program and your work authorization.
